Can Nursing Homes be Sued for Corporate Negligence in Pennsylvania?

A recent decision by a Pennsylvania Superior Court panel unanimously says yes.  The three judge panel found that nursing homes provide “comprehensive and continual physical care” for patients.  Thus, the court reasoned, that nursing homes are more similar to hospitals than to doctors’ offices.

The decision stemmed from a case involving the death of a resident at the Highland Park Care Center.  The resident’s son alleged that his mother died because the nursing home failed to maintain appropriate staff levels to take care of the physical needs of patients and was thus negligent.
