Has Health Care Reform Moved One Step Closer to the Supreme Court?

Last week, the 11th Circuit Court of Appeals issued an opinion that held that Congress exceeded its constitutional authority when it passed health care reform law that required individual Americans to purchase health insurance.

The 11th Circuit decision conflicts with a June 2011 decision of the 6th Circuit Court of Appeals which found that Congress did have the power to require individual Americans to purchase health insurance.

When the federal circuit courts of appeals conflict on important matters of constitutional law, the U.S. Supreme Court may agree to grant certiorari and to hear the case so that there is uniformity throughout the country.  This matter is not yet before the Supreme Court, though it seems likely that it will be in the future.
