Can the Government Require You to Buy Health Insurance?

A key provision of President Obama’s healthcare reform legislation requires the medically uninsured to purchase health insurance by 2014 or to pay a fine equal to 2.5% of their annual salaries.  This particular provision of health care reform has been challenged by 26 states and is currently a matter of appeal before the 11th Circuit Court of Appeals.

President Obama’s administration is arguing that support for the Affordable Care Act can be found in the U.S. Constitution while a lawyer for the states opposing the Affordable Care Act argues that the government is punishing people for inactivity and exceeding the constitutional interstate commerce authority of Congress.
