2010 Pennsylvania Medical Malpractice Jury Verdicts by the Numbers

How common are Pennsylvania medical malpractice jury verdicts for plaintiffs? How large are the typical verdicts?

These common questions are best answered by looking at the data for the most recent year available, 2010.

In 2010:

  • There were 30 jury verdicts returned for plaintiffs in Pennsylvania medical malpractice cases.
  • The amount of the jury awards was as follows:
    • 4 were greater than $10 million
    • 6 were between $5 million and $10 million
    • 5 were between $1 million and $5 million
    • 9 were between $500,000 and $ 1 million
    • 6 were for $500,000 or less.

That same year there were also 133 verdicts issued in favor of Pennsylvania medical malpractice defendants.

However, it is important to remember that the vast majority of Pennsylvania medical malpractice cases end before trial. If a defendant expects, based on the medical evidence, that a plaintiff will succeed at trial then the defendant will most likely settle the case rather than risk a jury award.
